भाजपा सरकार को आदिवासियों के संवैधानिक अधिकारों को कुचलने नहीं दिया जाएगा : कहा किसान सभा ने, 7 को हसदेव में नागरिक प्रतिरोध मार्च
रायपुर। संविधान की रक्षा की शपथ लेकर शासन करने वाली किसी भी सरकार को आदिवासियों के संवैधानिक अधिकारों को कुचलने तथा उनके हित में बनाए गए कानूनों का उल्लंघन करने का अधिकार नहीं है। लेकिन हसदेव अरण्य के मामले में भाजपा सरकार ठीक ऐसा ही कर रही है और इसीलिए उसके खिलाफ नागरिक प्रतिरोध संगठित किया जा रहा है। हसदेव के मुद्दों के प्रति चिंतित प्रदेश के सभी संवेदनशील नागरिक और संगठन 7 जनवरी को हसदेव में भाजपा सरकार के आदिवासी विरोधी और कॉर्पोरेटपरस्त रुख के खिलाफ नागरिक प्रतिरोध मार्च में शामिल होंगे।
उक्त बातें छत्तीसगढ़ किसान सभा के संयोजक संजय पराते ने कल यहां आयोजित एक संयुक्त पत्रकार वार्ता में कही। इस पत्रकार वार्ता को छत्तीसगढ़ बचाओ आंदोलन के संयोजक आलोक शुक्ला के साथ भारतीय किसान यूनियन के प्रवीण श्योकंद, छत्तीसगढ़ मुक्ति मोर्चा (मजदूर कार्यकर्ता समिति) के कलादास डहरिया तथा अमित बघेल आदि ने भी संबोधित किया।
पत्रकार वार्ता को संबोधित करते हुए पराते ने कहा कि जल, जंगल, जमीन और खनिज राज्य का विषय है और इसलिए हसदेव के जंगल की कटाई राज्य सरकार की सहमति के बिना नहीं हो सकती। भाजपा पर कॉर्पोरेटपरस्त रुख अपनाने का आरोप लगाते हुए उन्होंने कहा कि वह पेसा कानून तथा आदिवासी अधिकार कानून का उल्लंघन कर रही है, जिसे मौजूदा सभी कानूनों पर सर्वोच्चता प्राप्त है। किसान सभा नेता ने ग्राम सभाओं का फर्जी प्रस्ताव तैयार करने वाले अधिकारियों और अडानी पर कार्यवाही करने, आदिवासियों को व्यक्तिगत और सामुदायिक वनाधिकार पत्रक देने, जिन आदिवासियों के वनाधिकार पत्रक छीने गए हैं, उन्हें वापस करने तथा विधानसभा संकल्प के अनुसार सभी कोयला खदानों का आबंटन निरस्त करने की मांग की।
आलोक शुक्ला ने पिछले माह दिसम्बर में हसदेव के जंगल काटे जाने के लिए वहां के ग्रामों को बंधक बनाने और उस क्षेत्र के आंदोलनकारी आदिवासियों को गैर-कानूनी ढंग से हिरासत में लेने के विस्तृत विवरण रखा। उन्होंने कहा कि कोयला खनन के लिए अडानी द्वारा जो अनुमतियां हासिल की गई हैं, वे ग्राम सभाओं के फर्जी प्रस्तावों पर आधारित है, इसलिए उसकी कोई वैधानिकता नहीं है। इन फर्जीवाड़े की जांच के लिए राज्यपाल द्वारा निर्देश दिए जाने के बावजूद राज्य सरकार द्वारा कोई कार्यवाही नहीं की जा रही है। उन्होंने पूछा कि यह कैसा कानून का शासन है, जो सार्वजनिक संपत्ति हड़पने वालों के साथ खड़ा है और इसका विरोध करने वाली आम जनता पर डंडे बरसा रहा है?

हसदेव में पेड़ों की कटाई और आदिवासियों के दमन के खिलाफ 7 को “नागरिक प्रतिरोध मार्च”, फर्जी ग्रामसभा प्रस्तावों के आधार पर कोल ब्लॉक को दी गईं सभी स्वीकृतियां निरस्त करे भाजपा सरकार
रायपुर। संविधान की पांचवी अनुसूचित क्षेत्रों के आदिवासियों और उनकी ग्रामसभाओं के सतत विरोध को दरकिनार करके एक पूंजीपति की लूट और भ्रष्टाचार के लिए हसदेव अरण्य के समृद्ध जंगल, जमीन, जल स्रोत और पर्यावरण का विनाश किया जा रहा हैl राज्य में नव गठित भाजपा सरकार के निर्देश पर भारी पुलिस बल तैनात कर निर्दयता के साथ सैकड़ों वर्ष पुराने हजारों पेड़ों को काट दिया गया। 21 से 23 दिसंबर तीन दिनों तक खनन प्रभावित सभी गांवों को नजरबंद किया गया, नेतृत्वकारी युवा साथियों और सरपंचों को अमानवीय तरीके से गिरफ्तार कर गैरकानूनी हिरासत में रखा गया l
हसदेव अरण्य में अडानी समूह के लिए भाजपा सरकार द्वारा की गई यह कार्यवाही न सिर्फ कार्पोरेट परस्ती का उदाहरण है, बल्कि आदिवासियों के उस विश्वास पर कुठाराघात है, जिसे चुनाव के वक्त भाजपा पर जताया गया था l छत्तीसगढ़ के हम समस्त जनवादी संगठन, जन पक्षीय राजनैतिक दल और पर्यावरण और आदिवासियों के प्रति संवेदनशील नागरिक राज्य सरकार की हसदेव अरण्य में की गई बर्बर कार्यवाही का पुरजोर तरीके से भत्सर्ना करते हैं l हम सब 7 जनवरी को नागरिक प्रतिरोध मार्च निकालकर हसदेव के संघर्षरत साथियों के आन्दोलन में एकजुटता प्रदर्शित करेंगे l
महत्वपूर्ण है कि इस सम्पूर्ण हसदेव अरण्य को बचाने के लिए पांचवी अनुसचित क्षेत्र के आदिवासियों और उनकी ग्रामसभाओं ने पिछले एक दशक में कई बार कोयला उत्खनन परियोजना का विरोध किया है, परन्तु अडानी कम्पनी के द्वारा ग्रामसभाओं के कूटरचित तरीके से फर्जी दस्तावेज तैयार करके विभिन्न स्वीकृतियां हासिल की गईं है। पूर्व राज्यपाल ने परसा कोल ब्लॉक प्रभावित गांव फर्जी ग्रामसभा प्रस्ताव की जाँच के आदेश दिनांक 23 अक्टूबर 2023 को मुख्य सचिव, छत्तीसगढ़ शासन को दिया था, परन्तु आज तक जाँच नही की गई l वर्तमान में जिस परसा ईस्ट केते बासेन कोयला खनन परियोजना के दूसरे चरण के लिए पेड़ो की कटाई की गई है, वह वन क्षेत्र ग्राम घाटबर्रा के सामुदायिक निस्तार का जंगल था l इस गाँव को प्राप्त सामुदायिक वन अधिकार पत्र को गैरकानूनी रूप से जिला स्तरीय समिति सरगुजा ने निरस्त किया था, जिसके खिलाफ उच्च न्यायालय बिलासपुर में मामला लंबित है l
ज्ञात हो कि हसदेव अरण्य मध्य भारत का समृद्ध वन क्षेत्र है जो जैव विविधता से परिपूर्ण कई विलुप्तप्राय वनस्पति और जीव-जन्तुओं का रहवास है l यह जंगल हसदेव नदी और उस पर बने मिनीमाता बांगो बांध का केचमेंट है जिससे जांजगीर, रायगढ़, कोरबा और बिलासपुर जिले की 4 लाख हेक्टेयर जमीन सिंचित होती है l
भारतीय वन्य जीव संस्थान (WII) ने हाल ही हसदेव अरण्य क्षेत्र पर विस्तृत अध्ययन किया है, जिसकी रिपोर्ट छत्तीसगढ़ शासन को सोंपी गई है l रिपोर्ट में सम्पूर्ण हसदेव अरण्य क्षेत्र को खनन गतिविधियों से मुक्त रखने की सिफारिश की गई है l रिपोर्ट में WII ने चेतवानी देते हुए लिखा है कि यदि हसदेव अरण्य क्षेत्र में कोयला खनन की अनुमति दी गई, तो न सिर्फ हसदेव नदी और पर्यावरण का विनाश होगा बल्कि मानव-हाथी संघर्ष इतना विकराल हो जायेगा कि उसे कभी सम्हाला नही जा सकता l
छत्तीसगढ़ विधानसभा ने दिनांक 26 जुलाई 2022 को सदन ने सर्वानुमति से संकल्प पारित किया था – “हसदेव अरण्य क्षेत्र में आवंटित सभी कोल ब्लॉक रद्द किए जाएँ” l छत्तीसगढ़ शासन ने दिनांक 1 मई 2023 को माननीय उच्चतम न्यायालय में शपथ पत्र प्रस्तुत किया है, जिसमे लिखा है कि हसदेव अरण्य में कोयला उत्खनन राज्य के हित में नही है l हसदेव क्षेत्र में किसी भी नए कोल ब्लॉक का आवंटन या खनन की जरुरत नही है l
हम सब संगठन इस बात पर कायम है कि हसदेव अरण्य में केंद्र और राज्य सरकार की सहमति के बिना एक पेड़ की भी कटाई नहीं हो सकती। इस समय जो पेड़ काटे जा रहे हैं, उसमें भाजपा राज्य सरकार की पूर्ण सहमति शामिल है और कांग्रेस पर दोषारोपण करके वह अपनी जिम्मेदारी से बच नहीं सकती। भाजपा सरकार को राज्य की आम जनता की भावना के अनुरूप आदिवासियों के संवैधानिक अधिकारों की रक्षा करते हुए हसदेव में खनन के लिए दी गई सभी अनुमतियों को रद्द करना चाहिए और विधानसभा के प्रस्ताव पर अमल करना चाहिए।

BJP government will not be allowed to crush the constitutional rights of tribals: Kisan Sabha said, Civil Protest March in Hasdev on 7th
Raipur. Any government that rules by taking an oath to protect the Constitution has no right to crush the constitutional rights of the tribals and violate the laws made in their interest. But in the case of Hasdev Aranya, the BJP government is doing exactly this and that is why civil resistance is being organized against it. All sensitive citizens and organizations of the state concerned about the issues of Hasdev will join the Civil Resistance (Nagrik Pratirodh) March on January 7 in Hasdev against the anti-tribal and pro-corporate stance of the BJP government.
Convenor of Chhattisgarh Kisan Sabha, Sanjay Parate said these things in a joint press conference held here yesterday. This press conference was also addressed by Alok Shukla, convener of Chhattisgarh Bachao Andolan, along with Praveen Sheokand of Bharatiya Kisan Union, Kaldas Dahriya of Chhattisgarh Mukti Morcha (Majdoor Karykarta Samiti) and Amit Baghel etc.
Addressing a press conference, Parate said that water, forest, land and minerals are state subjects and hence felling of Hasdev forest cannot happen without the consent of the state government. Accusing the BJP of adopting a pro-corporate stance, he said it was violating the PESA Act and the Tribal Rights Act, which has supremacy over all existing laws. The Kisan Sabha leader called for taking action against Adani and the officials who prepared the fake proposal of Gram Sabhas, giving individual and community forest rights pattas to the tribals, returning pattas to the tribals whose forest rights have been snatched away and demanded to cancel all the coal mines as per the assembly resolution.
Alok Shukla gave a detailed account of the cutting of Hasdev forest in December last month, taking the villagers there hostage and illegally detaining the agitating tribals of that area. He said that the permissions obtained by Adani for coal mining are based on fake resolutions of Gram Sabhas, hence they have no legality. Despite instructions from the Governor to investigate these frauds, no action is being taken by the state government. He asked what kind of rule of law is this, which is standing with those who grab public property and is beating the common people who oppose it?

“Civil resistance march” on 7th against cutting of trees and oppression of tribals in Hasdev, BJP government should cancel all the approvals given to coal blocks on the basis of fake Gram Sabha resolutions
Raipur. The rich forests, land, water sources and environment of Hasdeo Aranya are being destroyed for the plunder and corruption of a capitalist, ignoring the continuous protests of the tribals and their gram sabhas of the Fifth Scheduled Areas of the Constitution. On the instructions of the newly formed BJP government in the state, by deploying heavy police force, hundreds of years old thousands of trees were mercilessly cut down. For three days from 21st to 23rd December, all the mining affected villages were placed under house arrest, the leading youth agitators and Sarpanches were inhumanely arrested and kept in illegal detention.
This action taken by the BJP government for the Adani Group in Hasdev Aranya is not only an example of corporate favoritism, but is also an attack on the faith of the tribals, which was expressed in the BJP during the elections. We, all the democratic organizations of Chhattisgarh, political parties and citizens sensitive towards environment and tribal issues strongly condemn the barbaric action taken by the state government in Hasdev forest. We all will show solidarity with the movement of the struggling agitators of Hasdev by taking out a civil resistance (Nagrik Pratirodh) march on 7th January.
It is important that in order to save this entire Hasdev forest, the tribals of the fifth scheduled area and their gram sabhas have protested against the coal mining project several times in the last decade, but the Adani company has obtained various approvals by preparing fake documents of the gram sabhas. The former Governor had ordered an investigation into the fake Gram Sabha resolution of Parsa Coal Block affected village to the Chief Secretary, Government of Chhattisgarh on 23 October 2023, but the investigation has not been done till date. Presently, the second phase of Parsa East Kete Basen Coal Mining Project is underway. Trees have been cut for this, that forest area was the forest of community disposal of village Ghatbarra. The Community Forest Rights Certificate received by this village was illegally canceled by the District Level Committee Surguja, against which a case is pending in the High Court, Bilaspur.
Let it be known that Hasdev Aranya is a rich forest area of Central India which is home to many endangered flora and fauna full of biodiversity. This forest is the catchment of Hasdev River and the Minimata Bango Dam built on it, from which 4 lakh hectares of land in the districts of Janjgir, Raigarh, Korba and Bilaspur is irrigated.
Wildlife Institute of India (WII) has recently conducted a detailed study on Hasdeo Forest area, the report of which has been submitted to the Government of Chhattisgarh. In the report, the entire Hasdeo Forest area has been subjected to mining activities. In the report, WII has warned that if coal mining is allowed in the Hasdeo forest area, not only will there be destruction of the Hasdeo river and the environment, but the human-elephant conflict will become so severe that it can never be controlled.
Chhattisgarh Assembly had unanimously passed a resolution on 26th July 2022 – “All coal blocks allotted in Hasdev Aranya area should be cancelled”. Chhattisgarh Government has submitted an affidavit in the Honorable Supreme Court on 1st May 2023, in which It is written that coal exploration in Hasdev forest is not in the interest of the state. There is no need for allocation or mining of any new coal block in Hasdev area.
All of us in the organization are firm on the fact that not a single tree can be cut in Hasdev Aranya without the consent of the Central and State Government. The trees that are being cut at this time have the full consent of the BJP state government and it cannot escape its responsibility by blaming the Congress. The BJP government should protect the constitutional rights of the tribals in line with the sentiments of the general public of the state, cancel all the permissions given for mining in Hasdeo and implement the resolution of the Assembly.
